The Chocolate Party Store is the trading name of PASSION FOR CHOCOLATE Limited. The www.chocolatepartystore.co.uk website (“the website”) is wholly owned by Passion for Chocolate. All associated trademarks and images are protected and may not be used without the explicit written permission of Passion for Chocolate
Passion for Chocolate Limited, a company registered in England at Companies House, Company number is 5634591 with the registered Haed Office address being 24a, Coton Road, Nuneaton, Watwickshire. Orders generated from this website are fulfilled from 25, Lulworth Park, Kenilworth, Warwickshire.
By placing an order through the Chocolate Fountain Store website, you are agreeing to the following terms and conditions:
Delivery
Postage and Packing delivery charges are outlined on this website under the section "Postage". Passion for Chocolate Ltd are subject Royal Mail Postal charges and Courier charges applied to us. If there is or are any increases in their tariffs, we will endeavour to notify you as soon as possible.
Address
We will send the Order to the address we receive on the completed online form. Please ensure the address and postcode are accurate. We cannot be held liable for an incorrect address. If a parcel is returned to us, we will endeavour to try and contact you to either confirm the address or to send the parcel to an alternative address. Depending on the situation and the order, we cannot guarantee a free second delivery.
NOTE: If we are provided with an incorrect address and the parcel (your order) is sent out for delivery before the error is highlighted, you are not automatically entitled to a resend or a refund. Please check and double check the delivery address, contact information and any other applicable information required.
In the event that your order we sent is irretrievable, we may, at our discretion, arrange for another order to be sent out, subject to the details of the specific situation. Each error will be assessed on merrit. We cannot guarantee an automatic resending of the order.
Please note we currently only deliver to addresses within mainland UK.

Failure to Deliver
If we are unable to deliver your order to the address given on your oreder form (as provided by yourself on our site), we will attempt to leave the parcel or package in a secure place on the recipient's property.
Where this is not possible, we will attempt to leave your order with a neighbour. Please indicate that is acceptable to you on the order form.
If we are unable to deliver the order, we will attempt to contact you via telephone or email as soon as humanly possible.
We are not responsible for any other costs incurred by the customer due to failed deliveries.
For deliveries made by our courier company, their policy is to leave an official card if no one is in at the delivery address. They may attempt redelivery later in the day but do not guarantee that they will. Please make contact with the Courier company as soon as possible to aleviate any problems.
Signatures are required for delivery by Courier drivers, unless you specifically tell us otherwise in your delivery instructions. It is therefore important that you let us know if you would like us to leave on the porch, in the garden etc.
Delivery Instructions
Some delivery locations in the UK can be difficult to find (excluding Royal Mail deliveries). We therefore would ask you for as much relevent information in order to fulfil your order and delivery. If you are not at the location at the time of delivery, can the parcel be left with a neighbour, can it be left somewhere safe for you to collect later? Obviously there would be no proof of delivery on these occassions.
Please give alternative telpehone/mobile numbers as we will try and contact you regarding the non-delivery of the parcel/package. The number you have given may be the actual delivery address , but no one is in to answer the phone. An alternative mobile or landline number would be appreciated.
P.O. Boxes
Unfortunately, we are not able to accept orders to addresses containing a PO Box number or FREEPOST addresses.
Availability and substitution
All items sold on our website are subject to availabilty. In the event of any supply difficulties (out of stock), we reserve the right to substitute any product with an alternate product of a similar style and equivalent (or greater) value and quality. Where this is necessary, we will try to contact you via email. If you have ordered a Valhrona Chocolate we will NOT substitute it with a, for example Belcolade chocolate. If you have ordered Company "X's" 300 mm wooden skewers, and the availability is nil in our warehouse, we will substitute another 300mm wooden skewer of equal or greater quality.
If we are unable to contact you via the numbers you have given to us, prior to the time that we make up your order, we will assume that you accept our decision of resubstitution.
Melted Chocolate
We take extreme care in packing our parcels and packages for delivery. However during 'heatwaves' or odd UK days of hot weather, we cannot accept liability for melted chocolate or dipping products.
Our labels clearly state that the package/parcel should not be left
in direct 'hot' sunlight (in a porch for example). However we are at the discretion of the Royal Mail Postmen and ladies to physically read the label and place the parcel in a sensible position. We cannot and will not be held liable for melted chocolate items.
Fraudulent Behaviour
If we suspect or believe an order may be fradulent (for whatever reason) we reserve the right to cancel the order and/or refund the payment. We will inform the Police and co-operate with their investigations as well as the prosecution if applicable to the situation.
Duplicate Orders
Duplicate orders happen from time-to-time. If we notice this in our system, we will remove or delete the duplicate order and refund the order. We will endeavour to contact you as soon as possible to confirm the duplicate order or to confirm a cancellation.
Please let us know if you think you have accidently made an order twice. Some orders like these can slip through the net and duplicate orders sent. In these cases, we cannot refund the postage and packing charges.
Technical Faults
From time to time Internet access can 'go down' - no fault of our own. At some point when we are back 'live', data or orders may be lost in the process. We cannot take responsibility for any errors or loss of orders as a result of this. We apologize if we did not receive an order from you. If you have not received an order within a timely perioid, please feel free to contact us.
Deliveries - Weekends and Public Holidays
The Royal Mail and our Courier partner deliver on Saturdays, however they do not deliver on Sundays and Bank Holidays. We currently only deliver within mainland UK and do not ship outside the UK. It may be possible to deliver (by Courier only) on non-working days, however addtional costs will be incurred.
